1. A driver of a motor vehicle shall:
- Exercise due care to avoid a collision with a pedestrian;
- Give an audible warning with the horn of the vehicle if appropriate and when
necessary to avoid such a collision; and - Exercise proper caution upon observing a pedestrian: On or near a highway, street or road;
- At or near a bus stop or bench, shelter or transit stop for passengers of public mass transportation or in the act of boarding a bus or other public transportation vehicle; or
- In or near a school zone or a school crossing zone marked in accordance with NRS 484B.363 or a marked or unmarked crosswalk.
Nevada Law (NRS 41.130) further allows for the compensation for another’s wrongful act or negligence when suffering injury because of such wrongful acts and/or negligence:
“Whenever any person shall suffer personal injury by wrongful act, neglect or default of another, the person causing the injury is liable to the person injured for damages; and where the person causing the injury is employed by another person or corporation responsible for the conduct of the person causing the injury, that other person or corporation so responsible is liable to the person injured for damages.”
